Law that applies
These terms and every booking made under them are governed by the law of the Republic of Moldova, including the Civil Code (Law No. 1107/2002), Law No. 139 of 2 July 2010 on copyright and related rights, and, where the client is a private individual, Law No. 105/2003 on consumer protection. Nothing in these terms limits rights a consumer has under Moldovan law.
Estimates and bookings
Every job starts with a written estimate sent by email. It lists the shoot days, crew, halls, kit, deliverables, delivery dates, usage rights and price in Moldovan lei (MDL). An estimate is valid for 14 days.
A booking is confirmed when you accept the estimate in writing, by email is enough, and we receive the deposit. Until then, dates and halls are held for you for 72 hours and may be released to another client.
Payment
- A deposit of 30% of the estimate is due to confirm the booking.
- The balance is due within 10 calendar days of delivery of the final files.
- Hall hire without crew is paid in full before the hire date.
- We invoice in MDL and accept bank transfer. Clients abroad may pay in euro at the official rate of the National Bank of Moldova on the invoice date.
- Prices on this website include VAT where it applies.
Final files are released once the balance is paid. Selects galleries are shared before payment so you can choose images.
Changes and cancellations
- More than 7 days before the shoot: you may cancel or move the date free of charge, and the deposit is returned or carried over.
- Between 7 days and 72 hours before: 50% of the crew and hall fees are charged.
- Less than 72 hours before: the full crew and hall fees are charged, together with any costs we have already paid to third parties, such as props, models or permits.
For location days, a weather day is agreed in the estimate. If the forecast the evening before is worse than the agreed threshold, either side may move the shoot to the weather day without charge.
If we have to cancel, for illness of key crew or failure of essential equipment that we cannot replace, we offer a new date first. If no date suits you, we return everything you have paid for that job.
On the day
Shoot days run ten hours including a one-hour lunch break, normally 8:00 to 19:00 with load-in. Overtime is charged per started hour at the rate in the estimate. Halls must be left as they were found; the cove is repainted after use at our cost unless it was painted in a custom colour.
The client is responsible for damage caused by their team, talent or products to the studio, its equipment or the building, beyond normal wear. Our equipment is insured; this does not cover deliberate damage or negligence.
Locations, permits and releases
For shoots on public space in Chișinău we apply to the municipality and, where needed, other authorities on your behalf. Permit fees are passed on at cost. We cannot guarantee that an authority will grant a permit or keep to a date, and a refusal is not a cancellation by us.
We prepare model and property releases for every identifiable person and private location. The client is responsible for any talent or locations they provide themselves unless they ask us to handle the releases.
Delivery
- Selects: a private online gallery within 48 hours of wrap.
- Retouched stills: within 5 working days of your selection.
- Film: first assembly within 4 working days, final within 5 working days of your last notes.
- RAW files and footage: on a drive at handover, kept as backup by us for 24 months.
Two rounds of notes are included for each film and each batch of retouched stills. Further rounds, or changes to the brief after the shoot, are quoted separately.
Copyright and usage rights
Under Law No. 139/2010, the photographer or director who creates a work is its author, and moral rights such as authorship stay with them. The economic rights the client needs are transferred or licensed in the estimate: the media, territory and period in which the images and films may be used.
Unless the estimate says otherwise, the client receives a non-exclusive licence for unlimited online use and two years of print and outdoor use in the Republic of Moldova, starting on the delivery date. Wider or exclusive rights are available and priced in the estimate. Rights pass to the client once the job is paid in full.
We may show the work in our portfolio, on this website and in competitions, once the work is published by the client or six months after delivery, whichever comes first, unless the estimate includes a confidentiality clause.
Our liability
We take care to deliver what was agreed. If files are lost or damaged through our fault, our liability is limited to reshooting the affected material at our cost or, if that is not possible, returning the fees paid for it. We are not liable for indirect losses, such as lost sales or missed campaigns, except where Moldovan law does not allow such limits, including in cases of intent or gross negligence.
Force majeure
Neither side is liable for failure to perform caused by events beyond reasonable control, such as natural disasters, epidemics, war, a state of emergency, or acts of public authorities. The affected side must tell the other promptly, and both will agree a new date in good faith.
